INDUSTRIAL: J-Kraft has purchased a 19,200-square-foot building on 1.9 acres at 3040 Greens Road from Bico Drilling Tools. Rich Norris of Greenbriar Real Estate represented the seller. Mike Spears of The National Realty Group represented the buyer.
OFFICE: Gusma Properties has sold a 26,398-square-foot office building to an unnamed investor. The building is directly across from the Spring Branch Medical Center at 8831 Long Point. Maury Bronstein of Situs represented the seller.
LAND: Huttonco Development has purchased 1.2 acres at the northeast corner of Tidwell and C.E. King Parkway for a retail building. Jake Toner represented the buyer. Ed Cummins Jr. and Carlos Bujosa with McDade, Smith, Gould, Johnston, Mason + Co. represented the seller, US Home Development Co.-Lennar.

This dispute arose when APAC-Southeast, Inc., a provider of asphalt, assigned its subcontract with Bruce Albea Contracting, Inc. to C. W. Matthews Contracting Co., Inc. before the completing of a road project for the Georgia Dependent of Transportation. Although the subcontract specified that it could not be assigned, and although Matthews did not polish off kill the project, APAC sued Albea and its sureties, Western Surety Enterprise and Continental Casualty Company, for break of contract and under a payment bond. The pilot court granted APAC epitomization judgment against all three defendants for over $1.2 million increased by interest. On appeal, defendants argue that the woe court erred when it granted APAC consolidation judgment because APAC's breach by think of assignment negates its claim against both Albea and its sureties. Defendants also assert that the probationary court erred when it awarded pre-judgment interest. We reconcile that APAC has no breach of contract command, but affirm because defendants are jointly and severally obligated under the payment bond and because the issue of interest was not disputed in the lawsuit court.
